The operation of mobile court by the executive magistrate will continue until settlement of three appeals filed by the government against the High Court verdict over the mobile court act.
A five-member bench of the Appellate Division led by acting Chief Justice Abdul Wahhab Miah came up with the order on Tuesday.
Besides, the court fixed January 16 for next hearing.
Following three separate writ petitions, the High Court on May 11 last year declared unconstitutional the rules under which the executive magistrate run the mobile courts.
A mobile court on September 14, 2011 awarded 30 days imprisonment to Esthetic Properties Development Chairman Kamruzzaman for violating some clauses of Building Construction Act. He was released on September 20 over bail.
Then he filed a writ petition challenging legality of some clause and sub-clauses of the Mobile Court Act 2009. Later two more writ petitions were filed.
