The High Court is set to deliver its verdict on Tuesday (December 17) regarding the rule issued on why the 15th Amendment to the Constitution, which abolished the caretaker government system along with several other provisions, should not be declared unconstitutional.
The bench of Justice Farah Mahbub and Justice Debashish Roy Chowdhury will announce the verdict.
Earlier, on December 5, the High Court set today as the date for delivering the verdict after concluding hearings on the rule. The same bench fixed the date after 23 working days of hearings.
Representing the state in court were Attorney General Md. Asaduzzaman and Deputy Attorney General Md. Asad Uddin. Senior lawyer Dr. Sharif Bhuiyan argued on behalf of petitioner Badiul Alam of Sujan (Citizens for Good Governance). Additionally, Insaniyat Biplob, Gono Forum, and four other petitioners joined the case as intervenors.
On August 19, the High Court issued the rule questioning why the 15th Amendment, which abolished the caretaker government system, should not be declared invalid. At the time, the bench of Justice Naima Haider and Justice Shashanka Shekhar Sarkar issued the rule after hearing writ petitions filed by several individuals, including Sujan's Secretary, Dr. Badiul Alam Majumdar.
The 15th Amendment to the Constitution was passed in the National Parliament on June 30, 2011. This amendment officially recognized Sheikh Mujibur Rahman as the Father of the Nation, abolished the caretaker government system, and increased the number of reserved seats for women in parliament from 45 to 50.
