Review Hearing on Caretaker Government Issue Today

A review hearing on the verdict that annulled the 13th Amendment, which introduced the caretaker government system in the constitution, is scheduled for today.

The full bench of the Appellate Division will conduct the hearing on Thursday, October 24.

BNP Secretary General Mirza Fakhrul Islam Alamgir filed the review petition on October 16. Earlier, on August 25, five others, including SUJAN Secretary Badiul Alam Majumdar, submitted similar petitions. Most recently, on Wednesday, Jamaat-e-Islami Secretary General Professor Mia Golam Parwar also filed a petition, according to lawyer Mohammad Shishir Monir.

The caretaker government system was introduced through the 13th Amendment to the constitution in 1996. In 1998, three lawyers, including Advocate M. Salim Ullah, challenged the amendment’s validity by filing a writ petition in the High Court. On August 4, 2004, the High Court dismissed the petition and upheld the legality of the caretaker system.

Permission for a direct appeal was granted, and the petitioners appealed in 2005. On May 10, 2011, a seven-judge bench of the Appellate Division, by majority opinion, ruled to annul the 13th Amendment. Following the verdict, the 15th Amendment Act, which abolished the caretaker system, was passed in Parliament on June 30, 2011, and the related gazette was issued on July 3.
