Nizam Hazari’s parliament membership legal: HC

The High Court bench of Justice Abu Jafor Siddique has rejected the rule regarding the validity of Feni-2 constituency Member of Parliament Nizam Uddin Hazari’s membership. For that instance Hazari’s membership in the parliament is legal, said his lawyers.

To settle the matter of legality of Nizam Hazaris’ membership in the parliament, the High Court fixed the date for delivering verdict on February 27.

The case was placed in the task list of Justice Md. Abu Jafor Siddique’s single bench on February 6. March 1 was fixed the date for delivering verdict after several days hearing.

Barrister Shafiq Ahmed and Nurul Islam Sujan were the lawyers for Nizam Hazari. Kamrul Haque Siddique and Satya Ranjan Mandal were the lawyers for the writ petitioner.

On May 10, 2014 a report was published on a national daily referring Nizam Hazari mentioning that the lawmaker came out of jail by not serving the jail term. It was said that he was awarded 10 years imprisonment in an arms case on 16 August, 2000. But Nizam came out of the jail by serving 2 years 10 months less of the given punishment. Former Joint Convener of Feni district Juba League Shakhawat Hossain Bhuiyan filed a writ challenging the legality of Hazari’s membership as a lawmaker as he was elected during his term of imprisonment.

The writ said, according to the section 66 (2) (d) of the constitution any person will not be eligible for being a member of parliament or for running in election if he is jailed for at least two years in a criminal case and if five years period is not over following his release. According to this Nizam Hazari cannot be a member of parliament before 2015. But he was elected on January 5, 2014.

The prison authority submitted investigation report following High Court order.

Following the writ petition the High Court issued a rule on June 8, 2014 asking why the Jatiya Sangsad seat of Feni-2 will not be declared vacant.
