Review Hearing on Caretaker Government to Be Held on January 19
The Appellate Division has scheduled a new hearing date for the review petition challenging the verdict that annulled the 13th Amendment to the Constitution, which had introduced the caretaker government system.
On Sunday (December 1), a six-member Appellate Division bench, led by Chief Justice Dr. Syed Refaat Ahmed, set January 19 as the date for the hearing.
Earlier that morning, BNP’s lawyer Zainul Abedin requested a one-month extension, while representatives from Jamaat-e-Islami also filed a petition in the court regarding the matter.
The Appellate Division subsequently fixed January 19 for the hearing and noted that no further extensions would be granted on that day.
In October, separate review petitions were filed seeking the reinstatement of the caretaker government system. These petitions were submitted by BNP Secretary General Mirza Fakhrul Islam Alamgir, Jamaat-e-Islami Secretary General Professor Mia Golam Parwar, and Dr. Badiul Alam Majumdar, Secretary of Shujan (Citizens for Good Governance).
It is worth mentioning that on May 10, 2011, the Appellate Division of the Supreme Court declared the 13th Amendment to the Constitution, which introduced the caretaker government system, to be unconstitutional and annulled it. However, the court, led by then-Chief Justice A.B.M. Khairul Haque, opined that the 10th and 11th general elections could still be held under a caretaker government.
