
The fate of whether the Caretaker Government system will be restored to the constitution is set to be decided today.
On Thursday (November 20), the full seven-member bench of the Appellate Division, headed by Chief Justice Dr. Syed Refaat Ahmed, will deliver the verdict.
The court had set today for the judgment after ten consecutive days of hearings concluded on November 11.
The other members of the bench are Justice Md. Ashfaqul Islam, Justice Zubayer Rahman Chowdhury, Justice Md. Rezaul Haque, Justice S M Emdadul Hoque, Justice A K M Asaduzzaman, and Justice Fahima Mabub.
Previously, the court fixed November 20 for the verdict after 10 continuous days of hearings held on October 22, 23, 28, 29, and November 2, 4, 5, 6, and 11.
The case, which began on October 21, is considered one of the most debated constitutional cases in the country's recent history.
Representing the appellants in court was lawyer Dr. Sharif Bhuiyan. Senior lawyer Zainul Abedin and Barrister Ruhul Quddus Kajal represented the BNP, while Advocate Mohammad Shishir Monir argued for Jamaat-e-Islami.
Barrister Ehsan Abdullah Siddiqui, Barrister Badruddoza Badal, Advocate Mohsin Rashid, and Barrister Shahriar Kabir participated as intervenors.
The state side was represented by Attorney General Md. Asaduzzaman and Additional Attorney General Barrister Anik R. Haque.
The Caretaker Government system was incorporated into the Constitution of Bangladesh through the 13th Amendment in 1996.
This amendment was challenged in the High Court in 1998 through a writ petition filed by Advocate M. Salimullah and two other lawyers.
On August 4, 2004, the High Court dismissed the writ and declared the Caretaker Government system valid.
Subsequently, in 2005, the court granted leave to appeal against this verdict. Following this, the Appellate Division, on May 10, 2011, declared the 13th Amendment void by a majority opinion.
Subsequently, the 15th Amendment, passed by the National Parliament on June 30, 2011, formally abolished the Caretaker system.
After the change of government on August 5, 2024, five prominent individuals, including SUJAN Secretary Dr. Badiul Alam Majumdar, applied for a review of the verdict.
Meanwhile, BNP Secretary General Mirza Fakhrul Islam Alamgir, Jamaat Secretary General Professor Miah Ghulam Parwar, and freedom fighter Mofazzal Hossain from Naogaon also filed separate review petitions.
After hearing all the applications together, the Appellate Division is set to deliver its judgment today.
Legal experts believe this verdict could have a major impact on the country's future electoral system, political landscape, and constitutional structure.
The eyes of the political arena and all sectors of the country are now focused on the Supreme Court for today's ruling.
