Caretaker Govt Review Petitions: Hearing Set for Nov 17

The Appellate Division of the Supreme Court has fixed November 17 for the hearing of three separate review petitions challenging its 2011 verdict that scrapped the non-party Caretaker Government system.

A full bench of the six-member Appellate Division, headed by Chief Justice Syed Refaat Ahmed, fixed this hearing date for Thursday (October 24) morning.

Earlier, BNP Secretary General Mirza Fakhrul Islam Alamgir, Jamaat-e-Islami Secretary General Professor Miah Golam Parwar, and Sujon's editor Dr. Badiul Alam Majumdar filed three separate review petitions at different times to restore the system.

The 13th amendment to the constitution, which included the caretaker government system, was adopted by parliament in 1996.

In 1998, three lawyers including M Salim Ullah filed a writ in the High Court challenging the validity of this amendment. On August 4, 2004, the High Court Division dismissed the writ and declared the caretaker government system valid.

The ruling stated that in this case, any decision regarding the chief adviser of the caretaker government could be made based on consensus in parliament.
