High Court Bench Schedules Verdict on 15th Amendment Case
On Thursday (December 5), the High Court bench comprising Justice Farah Mahbub and Justice Debashish Roy Chowdhury set the date for delivering the verdict regarding the legality of the 15th Amendment to the Constitution.
The hearing on the writ petition challenging the 15th Amendment concluded on Wednesday (December 4).
The 15th Amendment Act was passed in Parliament on June 30, 2011, during the tenure of the Awami League government. On August 18 of the same year, five prominent individuals, including Badiul Alam Majumder, Secretary of Shujan, filed a writ petition challenging the amendment.
Earlier, on August 19, the High Court issued a rule following a preliminary hearing. The rule asked why the 15th Amendment should not be declared unconstitutional.
Several organizations and individuals, including BNP, Jamaat, and Gono Forum, became parties to the case.
During the hearing, lawyers argued that the 15th Amendment simultaneously included provisions for Islam as the state religion, the invocation "Bismillahir Rahmanir Rahim", and secularism, which they claimed are contradictory and conflicting. They also argued that the amendment destroyed the system of free and fair elections in the country.
