Review Hearing on Caretaker Government System Set for Sunday

The Supreme Court's Appellate Division has scheduled a hearing for Sunday (January 19) on the review petition seeking reconsideration of the verdict that annulled the 13th Amendment to the constitution, which had introduced the caretaker government system.

According to the Supreme Court's website on Saturday (January 18), the petition is listed as item number 13 on Sunday's hearing schedule.

Chief Justice Dr Syed Refaat Ahmed's Appellate Division fixed January 19 for the hearing during a session on December 1. Representing the petitioners in court were senior lawyers Zainul Abedin, Sharif Bhuiyan, and advocate Mohammad Shishir Monir. Attorney General Md Asaduzzaman appeared on behalf of the state.

BNP Secretary General Mirza Fakhrul Islam Alamgir filed the review petition on October 16 against the verdict cancelling the 13th amendment of the constitution, which abolished the caretaker government system. Prior to this, Dr Badiul Alam Majumdar, Secretary of Citizens for Good Governance (SUJAN), also filed a review.

Additionally, Bangladesh Jamaat-e-Islami's Secretary General, Professor Mia Golam Parwar, submitted a review petition on behalf of the party. All these review petitions have been scheduled for a joint hearing.

The 13th amendment to the constitution, introducing the caretaker government system, was passed by the National Parliament in 1996. Advocates, including M Salim Ullah, challenged the legality of this amendment in the High Court. On May 10, 2011, the Supreme Court's Appellate Division declared the 13th Amendment unconstitutional and annulled it. Following the verdict, the 15th amendment, which abolished the caretaker government system and addressed several related issues, was passed in Parliament on June 30, 2011.

The official gazette regarding this amendment was published on July 3, 2011.

Additionally, on December 17, a High Court Division bench comprising Justice Farah Mahbub and Justice Debashish Roy Chowdhury declared Sections 20 and 21 of the 15th amendment law—regarding the abolition of the caretaker government system—as unconstitutional and void.
