The High Court has given an observation saying that if there is any allegation of river encroaching or filling up river against somebody then he or she will not be able to take part in election. The court also said that they will not be allowed to take loan from any bank.
The High Court bench comprising Justice Mainul Islam Chowdhury and Justice Md. Ashraful Kamal delivered the verdict on Sunday.
In this regard the court said, if there is any allegation of river encroaching found against any person then he or she will be declared ineligible for running all types of election. That means he or she cannot participate in national parliament, upazila, municipal and union council elections. River Protection Commission will monitor the allegation.
Earlier the court issued rule on January 9, 2016 to take steps for recovering the lands of Turag river from the illegal grabbers within 48 hours. Later on January 5, 2017 BIWTA submitted report to the High Court over taken steps for recovering lands of Turag river. On that day the High Court ordered Gazipur Chief Judicial Magistrate to submit report after investigation for conducting judicial investigation report.
On October 11, 2017 the Chief Judicial Magistrate submitted the survey report to the court. On December 13 of the same year the court ordered the concerned authority to recover the lands from illegal grabbers according to the survey. As some people filed appeal against the eviction order then Appellate Division on January 14, 2018 stayed the High Court order and delivered verdict for rule hearing.
After presentation of arguments in the process of rule hearing in the High Court bench of Justice Mainul Islam Chowdhury and Justice Md. Ashraful Kamal the incomplete verdict was delivered on Sunday.
